Preparing an Ontario Small Claims Case: Evidence Checklist

A clear Small Claims Court file connects the facts, the legal remedy requested, and reliable supporting evidence. Start organizing early and confirm the current court rules, forms, limits, and deadlines.

Documents to collect

  • Contracts, estimates, purchase records, invoices, receipts, and payment confirmations.
  • Complete emails, letters, messages, and notices in chronological order.
  • Photographs or video with dates, locations, and an explanation of who created them.
  • Repair records, replacement costs, expert material, and calculations supporting the amount claimed.

Build the chronology

List the important events in date order. For each event, identify the people involved and the document or witness that supports it. Separate what you directly know from what someone else reported.

Make the file usable

  • Keep originals secure and prepare readable copies.
  • Use a consistent page-number and document-index system.
  • Identify potential witnesses and what each can personally establish.
  • Calculate the requested amount clearly and avoid unsupported estimates.
Procedure and limitation issues can affect an otherwise valid claim. Obtain advice promptly if a deadline, defendant identity, service issue, or counterclaim may be involved.
